Need help Filing a complaint against Rikers Island and NYC?
Are you looking for help in filing a complaint against rikers island or NYC? Have you or a loved one been attacked while at Rikers? You can file a complaint in numerous ways. One can always call 311 to lodge a complaint. You can also file a grievance while incarcerated at Rikers although the efficacy of filing a grievance is questionable.
Filing a complaint via a notice of claim may make you a few bucks, but are you looking for more immediate change? If so, you should speak with your criminal defense attorney. They can often make motions in court to get immediate action. (see below for more detail on how) However, if you want compensation, filing a complaint, or notice of claim, is the best way to go. Often times doing all three will get an internal investigation opened up. What are the three you ask? (i) filing a complaint, (ii) filing a notice of claim and (iii) filing a grievance.
Procedure
So what happens once they are filed correctly? Great question! Well first the City takes some time assigning it a claim number. Then, they inform you about a 50h hearing (which you could read more about here). Once the transcript is received from the 50h hearing, your attorney can draft a packet. That packet then gets sent to the City for an early settlement conference. At that point, either they offer enough, or they don’t – only you can decide.
Again, if you are incarcerated, we always recommend the best option being to lodge a complaint with your criminal defense attorney. They can motion to the judge for imminent action, for instance, asking the judge to assign you to protective custody, or asking the judge to force the DOC to administer medical attention, etc.. Nevertheless, if you want to file a notice of claim, do so by contacting us here.
